TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
ARENA BATTLES DISCLAIMS ALL WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

- EVERY ERROR WILL BE CORRECTED.
- THIRD-PARTY GAMES OR SERVICES WILL FUNCTION PROPERLY.
- EVERY MATCH WILL BE FREE FROM NETWORK OR TECHNICAL ISSUES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARENA BATTLES LLC'S AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- $100; OR
- THE AMOUNT YOU PAID DIRECTLY TO ARENA BATTLES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
THIS LIMITATION DOES NOT REDUCE AN UNDISPUTED PRIZE OR PAYOUT THAT ARENA BATTLES HAS FINALLY DETERMINED IS PAYABLE TO YOU UNDER APPLICABLE COMPETITION RULES.
Some jurisdictions do not permit certain exclusions or limitations of liability, so portions of this section may not apply to you.
40Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Arena Battles LLC and its affiliates, owners, officers, directors, employees, contractors, agents, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from:
- Your violation of these Terms.
- Your violation of applicable law.
- Your infringement of another person's rights.
- Content you submit.
- Fraudulent conduct.
- Your participation in conduct prohibited by Arena Battles rules.
This section does not require indemnification to the extent a claim resulted from Arena Battles' own unlawful conduct.
41Changes to the Terms
Arena Battles may update these Terms as the Platform, competitions, technologies, laws, or business practices change.
When we update the Terms, we will revise the "Last Updated" date.
If a change is material, we may provide notice through:
- The Platform.
- Email.
- An account notification.
- Another reasonable method.
Where required by law, we will request renewed acceptance.
Changes will not retroactively alter the outcome of a completed competition unless necessary to correct fraud, cheating, an administrative error, or comply with law.
42Termination by You
You may stop using Arena Battles at any time.
You may request account deletion using available account settings or support channels.
Closing your account does not automatically:
- Cancel obligations arising before closure.
- Reverse completed transactions.
- Eliminate competition records.

- Restore forfeited prizes or reversed results.
43Termination by Arena Battles

You must send Arena Battles a written notice describing:
- Your full name.
- Your Arena Battles username, if applicable.
- The email address associated with your account.
- A description of the dispute.
- The facts supporting your position.
- The relief you are requesting.

The parties will have 30 days after receipt of a complete notice to attempt to resolve the dispute.
During that period, both parties agree to make reasonable good-faith efforts to resolve the dispute without arbitration or litigation.
If the dispute has not been resolved after the 30-day period, either party may proceed as permitted below.
45Agreement to Arbitrate
Except for disputes excluded below, you and Arena Battles agree that disputes arising out of or relating to these Terms, the Platform, or your relationship with Arena Battles will be resolved through individual binding arbitration rather than in court.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
Arbitration will be administered by the American Arbitration Association ("AAA") under its applicable Consumer Arbitration Rules in effect when the arbitration is filed, as modified by these Terms.
The arbitrator may award any individual remedy available under applicable law.
The arbitrator will have authority to resolve disputes regarding the interpretation, applicability, formation, or enforceability of this arbitration agreement, except questions concerning the enforceability of the Class Action Waiver, which may be decided by a court of competent jurisdiction.
Nothing in this section prevents either party from seeking temporary or emergency injunctive relief from a court where reasonably necessary to prevent immediate misuse of intellectual property, unauthorized system access, fraud, or other imminent harm.
46Arbitration Exceptions
The arbitration requirement does not apply to:
- An individual claim eligible for small claims court, if pursued individually.
- Claims concerning ownership or infringement of intellectual property where court relief is appropriate.
- Claims seeking temporary or emergency injunctive relief as permitted by these Terms.
- Claims that applicable law does not permit to be arbitrated.
Either party may pursue an eligible individual claim in small claims court instead of arbitration.
47Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND ARENA BATTLES AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY.
NEITHER PARTY MAY PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION ARISING FROM A DISPUTE SUBJECT TO ARBITRATION.
AN ARBITRATOR MAY AWARD RELIEF ONLY TO THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO RESOLVE THAT PARTY'S INDIVIDUAL CLAIM.
If this Class Action Waiver is determined to be unenforceable with respect to a particular claim or request for relief, that claim or request will proceed in a court of competent jurisdiction after any arbitrable portions are resolved.
48Arbitration Opt-Out
You may opt out of the arbitration agreement contained in Sections 44 through 47 by notifying Arena Battles within 30 days after the date you first accept these Terms.
Your opt-out notice must:
- Clearly state that you are opting out of the arbitration agreement.
- Include your full legal name.
- Include your Arena Battles username, if applicable.
- Include the email address associated with your Arena Battles account.
Opt-out notices must be sent to:
Your opt-out will apply only to you.
Opting out of arbitration will not affect any other provision of these Terms or your ability to use Arena Battles.
49Governing Law
Except to the extent federal law applies or applicable law requires otherwise, these Terms and any dispute arising out of or relating to these Terms, the Platform, or your relationship with Arena Battles LLC will be governed by the laws of the State of Delaware, without regard to its conflict-of-law principles.
The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions contained in these Terms.
Nothing in this section deprives you of mandatory consumer protection rights that cannot lawfully be waived under laws applicable to you.
50Venue
For any dispute that is not required to be resolved through arbitration and is not properly brought in small claims court, you and Arena Battles LLC consent to the exclusive personal jurisdiction and venue of the applicable state or federal courts located in the State of Delaware, except where applicable law gives you a non-waivable right to bring a claim in another jurisdiction.
You and Arena Battles waive any objection to those courts based on personal jurisdiction, venue, or inconvenient forum to the extent permitted by law.

Arena Battles may take reasonable measures to protect ongoing competitions affected by such events.
52No Waiver
Failure by Arena Battles to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.
53Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.
54Assignment
You may not assign or transfer your rights or obligations under these Terms without Arena Battles' prior written consent.
